The Illinois Employee Sick Leave Act goes into effect on January 1, 2017

 

Who is covered and how much sick leave?

Employees who have employer provided personal sick leave benefits - it depends on the employers plan how much the sick leave is.

How to use sick time?

  • For own illness, injury, or preventive medical appointment;
  • To care for a sick or injured (step)parent, grandparent, spouse, child, brother, sister, parent-in-law, grandchild.

 

An employer may limit the use of personal sick leave benefits provided by the employer for absences due to an illness, injury, or medical appointment of the employee's (step)parent, grandparent, spouse, child, brother, sister, parent-in-law or grandchild to an amount not less than the personal sick leave that would be accrued during 6 months at the employee's then current rate of entitlement.

Violations of sick leave rights - what to do?

Workers who believe they have been denied sick leave, or retaliated against for requesting or taking leave, may file a complaint with the Illinois Department of Labor.
