Executive Exemption

The employee must :

  • manage the enterprise or department in which employed.
  • direct the work of two or more other workers.
  • receive a salary basis of $475.00 per week ($455.00 under FLSA
    The employee must: 
  • have met the above criteria plus a wage of $400.00 per week.
  • be authorised to hire or fire workers or make recommendation regarding hiring, firing, promotion or other changes in the status of workers.
  • exercise discretionary powers.
  • not devote more than 20% (or 40% in the case of a retail or service employee) of his  workweek to activities that are not related to the performance of the work as described above.

    Administrative Exemption
    The employee must:
  • have a salary basis of $475.00 per week.
  • have a primary task must be the performance of office or non-manual work directly related to management policies or general business operations, or the performance of administrative functions in an educational setting in work directly related to academic instruction or training.
  • exercise discretion and independent judgment
  • assist a proprietor, or employee employed in a bona fide executive or administrative capacity; or,
  • work under only general supervision along specialized or technical lines requiring special training, experience or knowledge; or,
  • execute under only general supervision special assignments or tasks
  • not devote more than 20% (40% for retail or service establishment employees) of his work week to activities not directly and closely related to the performance of the work described above.

    Professional Exemption 
    The employee must:
  • receive a salary basis of $475 per week except lawyers, doctors, and teachers.
  • have work requiring knowledge of an advanced type in a field of science or learning; or
  • have original and creative work in an artistic field; or 
  • require the consistent exercise of discretion and judgment;
  • have work predominantly intellectual and varied in character; and of such character that the output produced or the result accomplished cannot be standardized.
