Miami Beach Minimum Wage to $13.31 Struck down in Court

03/30/17 - Miami Beach's new minimum wage law, which aims to raise the citywide wage to $13.31 by 2021, is struck down in court. The Florida Retail Federation, Florida Restaurant & Lodging Ass. and Florida Chamber of Commerce filed suit in December over the city ordinance, arguing it is preempted by state law. Judge Peter Lopez invalidated the ordinance, ruling in favor of State law and the business groups. Miami Beach's lead counsel, Robert Rosenwald, said the city will file an immediate appeal. Minimum Wage Tipped Workers

Cash wage: $5.08

Maximum Tip Credit: $3.02

Note:The cash wage or basic or direct wage rate is the minimum required employer contribution towards your hourly minimum wage. The "maximum tip credit" is the amount of tips you will need on top of your cash wage to make the minimum wage of $8.10 per hour. If you do not receive sufficient tips in your workweek to achieve the minimum wage for all hours worked that week, your employer must make up the difference.

Minimum Wage Trainees, Internship

Interns or trainees in the for-profit private sector who are qualifying more as employees than as trainees must be paid at least the minimum wage and overtime compensation for more then 40 hours worked in a workweek.

Overtime Pay Florida

Overtime Pay Florida: $12.15
Overtime pay is the cash compensation for the hours eligible employees work in excess of 40 hours in a workweek (a workweek = 7x24= 168 hours). The overtime pay rate is one and one-half (1.5) times the regular working hour rate of pay.

St. Petersburg Civil Service Union Employees

Full-time and part-time employees of the Florida Public Service Union, with at least five years on the job, will earn a minimum of $12.50 an hour by December 29th, 2014. 

Hourly employees at the top of the pay scale will get a 2 percent annual increase.


Violations Minimum Wage

If you didn't receive the minimum wage you may bring a civil action against your employer or any person violating Florida's minimum wage. The state attorney general may also bring an enforcement action to enforce the minimum wage.
