Is Waitstaff Entitled to a Paid Vacation?

Ask Paywizard - Is waitstaff entitled to a paid vacation? Paywizard.org answers.
Question - Date: 2010

The organization I work for (in the state of Georgia) offers vacation time of ten working days per year to waitstaff. Is that waitstaff paid tipped rate of $2.58 or is the waitstaff due minimum wage for vacation time?

Answer Paywizard.org:

You have to check the vacation policies of your employer. There are employers who provide paid vacation, but neither federal or state law requires that an employer provide (paid) vacation. Employers are free to create their own vacation policies that can have different eligibility requirements and offer different benefits to different groups of employees. As long as the policy is followed, is applied consistently, and does not illegally discriminate, employers generally can craft whatever vacation policy that meets their business need.
